American Civil Liberties Union records User Agreement Form

As a condition precedent of obtaining research access to the American Civil Liberties Union ("ACLU") Records, as described below, archived in the Princeton University Library, I covenant that the information provided by me is true and complete.

I further agree that:

  1. I have read and understand the Princeton University Library's access policy for the ACLU Records.
  2. If in the course of my research I should obtain access to any information in ACLU records which I believe is closed as defined in the access policy, I shall immediately notify the staff of the Princeton University Library of this discovery and request that appropriate action be taken. I shall make no use whatsoever of closed information, including without limitation, by publication or any other disclosure. However, when I have obtained access to information in a record that contains both closed and open information, I shall retain access to the open information in that record. Examples of closed records or closed information in records include the names, addresses, and identities of any living individuals if their presence in the records reveals any information regarding or is linked to personnel actions, membership in the ACLU, donations to the ACLU, client or attorney work product privileged communications, or any other categories of of personally identifiable information of a personal or confidential nature, such as medical information, arrest records, military service records, etc.
  3. I acknowledge that other individuals, corporations, other legal entities, and other third persons may have rights in ACLU records to which I may obtain access, for examples, rights of privacy, of copyright (including without limitation, common law, statutory, executive agreement, or treaty), of literary property, and are not to be defamed. I accept full responsibility for respecting those rights and agree to indemnify, defend, and hold harmless Princeton University, the ACLU, and the trustees, directors, officers, and employees thereof, from any claim or liability to third parties which may arise out of or in connection with my access to or use of the ACLU Records, including without limitation, damages, the costs and expenses of litigation, and of attorneys, including attorneys' fees.

The provisions of this agreement may be waived if documentation satisfactory to the Princeton University Library is provided by the researcher that i) all parties named in closed records are now deceased and/or ii) all parties named in closed records have given their permission to disclose said information and/or iii) the information is a matter of public record. All such documentation must be sent to Princeton University.
